Terms of Service & Data License

1. Public Records Provenance & Authority

Surplus Docket aggregates, filters, formats, and indexes public court records, overage schedules, and tax deed sale registries pursuant to applicable state freedom of information laws and governing statutes, including:

  • Florida: Fla. Stat. § 197.582 and Chapter 119 Public Records.
  • Texas: Tex. Tax Code § 34.04 and Texas Public Information Act.
  • Georgia: O.C.G.A. § 48-4-5 and Georgia Open Records Act.

Surplus Docket is an independent legal data intelligence provider and is not affiliated with, endorsed by, or acting on behalf of any municipal court clerk or government agency.

2. Subscription & Commercial Data License

Subject to active subscription payment, Surplus Docket grants subscribers a non-exclusive, non-transferable commercial license to use delivered CSV feed files, REST API payloads, and motion dossiers for their internal legal practice, asset recovery operations, or real estate investing.

Subscribers may not re-sell raw bulk feed data, publicly mirror the REST API endpoints, or distribute un-redacted databases to non-subscribing third parties without prior written consent.

2.1 Service Delivery Windows, Docket Dispatch Schedules & Court Record Ingestion Lags

Surplus Docket targets morning email dispatch of daily court intelligence feeds by 7:00 AM Eastern Standard Time (EST) on standard court business days (Monday through Friday, excluding statutory federal and state judicial holidays).

Subscribers expressly recognize and agree that data compilation is contingent upon upstream public records availability, circuit court clerk filings, county overage schedule reconciliations, third-party municipal server uptimes, and telecommunications routing.

Consequently, morning delivery timing represents an operational target and may fluctuate, delay, or be dispatched later during court business hours or upon clerk release. Delivery timing variations—including feeds dispatched later in the morning or afternoon, court holiday closures, or technical transmission buffer pacing—do not constitute a service failure, material defect, breach of contract, or default of performance.

No Delivery Delay Refunds or Chargebacks: Subscribers agree that fluctuations in daily dispatch times do not provide grounds for subscription refunds, fee prorations, chargebacks, billing disputes, or early contract termination. All scheduled daily feeds fulfilled within the corresponding calendar cycle constitute full and timely delivery of services.

The materials, calculations, statutory benchmark references, and sample motion templates provided by Surplus Docket are for informational and operational assistance only and do not constitute formal legal advice.

Attorneys and recovery practitioners must exercise independent professional judgment, verify case standing on respective county clerk portals, and ensure compliance with local bar association rules.

4. Subscription Billing & Refunds

Subscriptions are billed in advance on a recurring monthly or annual basis via Stripe. You may cancel your subscription at any time with 1 click in the Stripe Customer Billing Portal.

Refunds are governed by our Refund & Cancellation Policy. In accordance with Section 2.1, delivery timing variances, courthouse batch releases, or clerk schedule adjustments do not qualify for refunds, prorations, or credits.
